Welcome to BakeSuite (“we”, “us” or “our”). These Terms & Conditions govern your access to and use of our website (www.bakesuite.com.au), app, and related services (collectively, the “Service”). By accessing or using BakeSuite, you agree to be bound by these Terms. If you do not agree with any part, please do not use our Service.
1. Eligibility
To use BakeSuite, you must be at least 18 years of age and capable of entering into a legally binding agreement. By using our Service, you represent and warrant that you meet these requirements.
2. Account Registration
To access most features, you must register for an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your login details and for all activity under your account.
3. Subscription & Billing
BakeSuite operates on a subscription model. The current pricing is listed on our website and is billed in United States Dollars (USD) unless otherwise specified.
Subscriptions are billed monthly unless otherwise stated. You may cancel your subscription at any time through your account settings. Your access will remain active until the end of the current billing cycle.
We do not provide refunds for partial billing periods. However, refunds may be considered in exceptional circumstances, including billing errors or significant service outages. Please contact us at support@bakesuite.com.au to request a review.
Price Changes
We reserve the right to change the subscription fees at any time. Any pricing updates will apply to future billing cycles and will not retroactively affect the current term. If the subscription price is set to change, you will be notified in advance via email or through the Service. Continued use of the Service after the effective date of the price change constitutes your acceptance of the new fee.
5. Data Security
We may offer a limited-time free trial. At the end of the trial period, your account will automatically convert to a paid subscription unless cancelled before the trial expires.
5. User Content
You retain full ownership of all data, recipes, customer records, and other content you create or upload to BakeSuite (“User Content”). By using the Service, you grant us a limited licence to store, back up, access, and process your content only as needed to operate and support the Service.
You are solely responsible for the legality, reliability, and appropriateness of your User Content, and for ensuring it does not violate any applicable laws or third-party rights.
We may access User Content only when necessary to:
- Provide technical support
- Resolve service issues
- Improve and maintain system functionality
6. Data Storage & Security
BakeSuite uses secure, reputable third-party infrastructure to host and protect your data. While we implement industry-standard security measures, no system is completely immune to risk. By using the Service, you acknowledge and accept this. For more information on how we collect, use, and store personal data, please refer to our Privacy Policy.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful, harmful, or fraudulent purpose.
- Attempt to reverse engineer, copy, or resell any part of the Service.
- Upload or transmit malware, viruses, or any malicious code.
- Interfere with the functionality of the Service or the experience of other users.
8. Service Availability
We strive to provide reliable and continuous access to the Service but do not guarantee uninterrupted availability. We may modify, suspend, or discontinue the Service (or any part of it) at any time without notice.
9. Termination
We reserve the right to suspend or terminate your access if you breach these Terms or engage in behaviour that negatively affects the integrity of the Service or its users. You may cancel your subscription at any time via your account settings.
10. Third-Party Services
The Service may integrate with external services such as Stripe or Square for payment processing. Your use of those third-party services is subject to their own terms and privacy policies. We are not responsible for their actions or any issues arising from their use.
11. Consumer Rights
Nothing in these Terms limits or excludes any guarantees, warranties, rights, or remedies provided under the Australian Consumer Law (ACL).
Where we are permitted to limit our liability under the ACL, our liability is limited to either:
- The resupply of the Service, or
- The cost of having the Service resupplied.
12. Limitation of Liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising out of or related to your use of the Service.
Subject to the ACL, our total liability to you for any claims related to the Service is limited to the total amount paid by you to us in the three (3) months preceding the event giving rise to the claim.
13. Disclaimer
The Service is provided “as is” and “as available” without any warranties of any kind, either express or implied. We do not guarantee that the Service will be error-free, uninterrupted, or suitable for your specific needs.
14. Governing Law
These Terms are governed by the laws of Queensland, Australia. You agree to submit to the exclusive jurisdiction of the courts in Queensland for any dispute arising under or relating to these Terms.
If you access the Service from outside Australia, you do so at your own risk and are responsible for compliance with your local laws.
15. Changes to These Terms
We may update these Terms from time to time. Changes will take effect when published on our website. Continued use of the Service after changes are posted indicates your acceptance of the revised Terms. We recommend checking this page regularly.
